Surely a few decals placed here and there to detract from the colour, would of been better than being nearly £13 out of pocket.

The Distance Selling Regulations say you should get a full refund including the cost of delivery of the goods to the consumer so yeah the shop would need to refund that too.

The other trick they like to try is a re-stocking fee for returns which again they can't do even if they have it in the terms and conditions

That's just what I was thinking, if I was sold something that was wrongly advertised....I would want the postage costs back too. If it was just out of choice I wouldn't ask for postage costs back.

No, it is not the shops responsibility to refund either postage, as the item wasn't faulty, just the buyer did not like the colour.

Ash I have a blue polybutler sitting here doing nothing if you want to buy it off me £20 and its yours I will be at Worksop if you are interested. It isnt in perfect condition but it is ok.

I'd have probably painted it myself - once lacquered, it'd be pretty scratch-proof!

Spencer - I'll PM you about the PolyButler - £20 + p&p sounds quite good!

The distance selling regs state that you can return goods for a full refund for whatever reason, the item doesn't need to be faulty even if it turns up and you have just changed your mind or don't like it! If you contact them and tell them you are sending it back within 7 days they must give you a full refund of the cost of the goods plus the original cost of delivery of the goods to the consumer. Any sum paid by the consumer must be repaid as soon as possible and, in any case, within 30 days of cancellation.

Seems like a croc of sh!t to me

That a retailer has to suffer and lose money because someone doesn't like a colour, when it says colour may vary.
Seems to me the retailer has done what he should, and gets a kicking in the sack for no fault of his own.
Fine, if the retailer is at fault, then yes, you deserve a refund, but if not, then in my eyes you "should" be entitled to a refund minus postage at the retailers discretion.

No, i'm not a retailer, just a person who has common sense, something evidently lacking in todays world

It is swings and roundabouts though, if Ash had gone in, as a foot customer, looked at the Polybutlers, seen he only had grey, he wouldn't of bought it, maybe, next time Ash will ask what colour, and maybe the shop will do the same too.

The whole idea of the distance selling, is that you have the same protection as a foot customer, like if you ordered a pair of trousers from a shop, you ordered the correct size, they come and don't fit etc, if you had gone to the shop, you would never of bought them.

mine is a dark matalic grey, not primer grey tho
