Default Paypal Seller protection

Every now and again I have been caught out on ebay.

On 6th February I sold a 4 month old sony ericcson Vivaz, in full working order. A couple of days ago the buyer emailed me after a full refund as the phone was 'not as described'. He stated that the phone was broken. He stated that he had shelled out on a new battery and charger, £20 to have it checked out only to be told that it was the phone at fault.

Absolute Poppycock but paypal have frozen almost £90 quid.

He has not responded to my emails when I asked questions in relation to 'which shop taken to', when did you start having problems...and why wait six weeks to contact me.
Any contact I have had is by particularly poor text speak, he has also called me 'babe' and signed off with a 'x'. If it wasnt for the fact that paypal do not cover items supposedly significantly not as described and I have had to transfer £90 from my bank account to cover it I would tell him to whistle for his refund.

Any advice based on experiences??? Thanks

You shouldn't have to refund anything unless it has been returned to you in the original condition, they also must provide paypal with tracking information to prove the return.


have had this a fair few (hundred!) times but you do have to ring Paypal up and make the point that someone is trying it on, you need to send all copies of e.mails to paypal as evidence.

This normally works but the phone calls take a long time and are expensive.

Either that or tell the buyer you want the item back before a refund and use their address to find the nearest army base... tell them you have friends in the army at the named local base and they will collect the item to save them postage costs... amazing but normally the disputes disappear.

Either that or knock up a fake solicitors letting demanding the funds returned... i know all of this makes me sound very dodgy and bending laws but i have been ripped off for £000,s when i used ebay as part of a business and having to deal with attempted online thieves everyday of the week!

at the end of the day, if you know the item was fine then they are trying to steal from you, using the corrupt ebay/paypal system that doesn't give enough protection to sellers.

Take a deep breath and say:

"I'm sorry you have experienced problems with the phone, I did believe it was in full working order.

I appreciate you have spent additional money, but had you alerted me to the problems I would have instantly offered you a full refund on return of the phone. If you would like to send it back, please let me know."

or to words to that affect.

Better to get the phone back, than lose the money and the phone. Hopefully if he's just trying a fast one, he'll go away.... Just remember always be polite as Ebay/Paypal may read all correspondence.

I have contacted Paypal who reviewed there and then and sided in my favour.
Fingers crossed I dont get a load of dodgy spam sent through now though

sorry to thread jack.

i have had to open a dispute with ebay due to an item not being delivered i paid for it on the 10th feb LOL and everytime i get the sorry ill sent it etc.. i opened a case with ebay regarding it and he said he will issue a refund but hasnt

do i need to open one with paypal as well? or just wait 10 days before i can escalate with ebay.......

im sure you oly have 45 days to open a paypal dispute

Unless the seller can provide paypal with a working tracking number showing the item has benn delivered and signed for by someone with your surname you will win the case. I'd allow 7 days if they arent communicating or 14 if they are before opening a dispute. If they don't respond to rhat within a day or so start a claim

Spot on Stoff, once won a b4 parts lot from the bay, Royal Mail misdelivered it (recorded delivery too) but as it was signed for by someone else - my case for a refund for non receipt of goods was not upheld by ebay- gutted

Step 1 - Open dispute right away

You can open a disputeA buyer asks for a seller's help in resolving an issue with a transaction. in the Resolution CentreLocated in My Account, the PayPal resource for resolving issues between buyers and sellers. to contact a seller directly and resolveA buyer and seller come to an agreement and close the case, or PayPal comes to a decision and closes the case. a problematic transaction. You have 45 days from the payment date to open a dispute. Common reasons for opening a dispute include:
  • You paid for an item but haven't received it and the seller is uncooperative or nonresponsive.
  • You received an item that was significantly different from how it was described.
Click the Report a Problem button in the Resolution Centre to open a dispute. Then, provide more information about the issue and post a message to the seller.

Make sure you're refunded or have the problem amended before you do this.

On a different note, but eBay/Paypal related; I believe many buyers who are claiming snad disputes are returning empty parcels, or parcels containing crap recorded delivery. So be sure to check the contents of the box before signing for it. Once your signature is received, paypal refunds the buyer and you're left with a box full of crap and revenue losses.
This, in addition to numerous other reasons is why I would never, ever sell via eBay.

I've successfully defended a similar claim at work for a similar instance. A customer claimed an item was returned to us for a full refund (which he was not eligible for hence the dispute) however he'd only returned a small jiffy bag with what he determined was the faulty part. He used the tracking number used on the jiffy bag for the return of the whole item.

I fought with Paypal and they didn't refund the customer. He'd used Interlink which have records of the item weight...
