Default Uninsured drivers

So what happens if you have been nailed by an uninsured driver, I got T boned the other day from some one pulling out of a side road as I was passing, but my insurers (tesco) have searched their database and the reg I have for the car does not come up as insured. I have been told someone will contact me within 48 hours but im impatient and don’t fancy being shafted, does anyone have any experience with this or is there anything I can do to speed things up etc

I would have thought he will get a ban, fine, etc and you will get shafted.

you can still make a claim, but it takes a lot longer to sort out, its all done the through the (m.i.b.) motor insurance bureau, this happened to me a few years ago.

if its a british registered car you can still claim through the m.i.b. as already said. if its a foreign registered car you can't claim a penny. found out when i was rear ended last year by a polish registered car

Its british registered, i thought i would have fun and games when i saw the fellas address and that he claimed he didn't have a land line

And the police aren't intersted unless your injured or causing an obstruction

You have to go to doctors with pain in neck,whiplash can come on days after crash then see police and inform them you were injured then they have to act.

I had a car written off by an uninsured driver, the insurance paid out no problem as I was fully comprehensive. The Police pursued it but the driver moved within a week or two of the accident and couldn't be found, then the Police then started blaming me for undue care and attention..... which ofcause didn't stick but only due to having a particularly good solicitor - although I was innocent its hard to defend yourself otherwise.

ive been hit twice and the motor insurance bureau wanted to go to court twice, it took over 6 months both times

in the end i had to get rid of the car as it was un road worthy and the police where not doing jack about it

good luck your gonna need it

I've been through a similar thing to you (hit by uninsured driver)

you can claim as described in previous posts, but just don't expect a speedy resolution. It can take an age to get everything sorted out. I eventually got paid out, but this was after a year roughly.

I'm with Tesco too and have the motor legal protection, If you have that too I'm guessing that will cover the cost of taking the guy to court if it comes to it.

Each time tescos sent my case out to and independent investigation team, it involves a lot of paper work back and forth, Court I believe is covered, but its down to how long you can hold out for, my car wasn’t worth a lot when it happened and in the end as the car was undrividable and unroadworthy I had to perches a new car, and I was told that it could be paid for if the case is one once it has been to court, and that could take over a year

So I didn’t bother, and changed from tesocs as they are no help once its passed on, and the lawyers they give you are crap and take 2 weeks to reply to a letter at a time

The police aren't interested because people only want to know them after things have gone wrong such as possibly in this instance? "No mate it's alright no need to call the police we can just swap details and let the insurance companies sort it out", "Yeah that's fine, we can do it like that". Oh no I've been fed a load of sh*t, I know I'll call, the police 3/4/5, day's later and let them try and find out who this bloke was driving a car that's not registered to them or insured to anyone.
If the car's not registered and it's only worth 2 goldfish and a toffee apple chances are post accident it will have been sold on or dumped. Short of the driver having some remarkably distinctive features how do you identify them?
But there you go people expect the old bill to get excited at the prospect of dealing with a pretty much no hope job when someone couldn't be arsed to call them in the first place.
When this doesn't happen some helpful person will encourage you to lie - You have to go to doctors with pain in neck,whiplash can come on days after crash then see police and inform them you were injured then they have to act.
The only action they have to take is to record it as an injury accident is recordable,. If there's no prospect of identifying the driver of the offending vehicle they won't take it any further than that.
Apologies Lee if this scenario doesn't apply in your circumstances but invariably the above is pretty near the mark

Gramey, I agree mate and most people do that, but from my experience if you are not obstructing traffic or nobody seriously injured then they wont come out. I have the fellas address and will be going round again to see if he is in, I think this one will just go through the motions and if im lucky ill get £5 a wekk until he dies
