Interestingly I did read one thing that said that if the phone doesn't know your 'my number' in the settings it won't work. Mine is 'unknown' but it won't let me edit it, which is annoying.

I managed to downgrade my iPod touch 3rd gen by downloading the software from
this website.
Then when you connect the phone to the computer, open iTunes, hold shift and click on restore, then find the software. I had to edit a iTunes file slightly to allow it to do this however, like in the 1st step of
this website.
Once I'd restored it I jailbroke it with Limerain, as I went back to 4.1.
I don't know whether this will solve your problem though.
