what is the best way to deal with an ebay non payer its never happened to me before

E-mail ,the buyer give them time to reply / or pay for the item .Report as a non payer . Have you checked there feed back ????.

contacted on sunday said they would pay monday contacted again tuesday said the would paypal me never had to go through resolution for non payment

Its a pet hate of mine. Do resolution center, if still not paid and your unhappy, give that tool a neg :)
